TERMS AND CONDITIONS

These Terms and Conditions (together with our Privacy Policy and Website Terms of Use) (“Terms and Conditions”) contain information about us and set out the legal terms applicable to purchases and orders of HYGIACTIVIA products (“Products”) and services (“Services”) via our stores (“Maison La HYGIACTIVIA”) and our website.

By purchasing Products or Services, you agree to be bound by these Terms and Conditions.

1. DEFINITIONS

1.1 Defined terms are capitalised and have the meaning given where defined.

1.2 “We”, “us”, “our” refers to HYGIACTIVIA SARL.
“You” refers to the customer.

3.3 Products may vary in size, weight, and presentation.

3.4 All Products are subject to availability.

3.5 All Products are factory sealed for hygiene and safety reasons.

3.6 Some Products may be offered on a pre-order or “reserve” basis, meaning they are not yet in stock at the time of purchase. Such Products are subject to Section 5.6.

4. YOUR ONLINE ACCOUNT

4.1 Account creation is optional.

4.2 You must provide accurate and complete information.

5. CONCLUSION OF CONTRACT & TRANSFER OF RISK

5.1 You must be at least 18 years old.

5.2 Products are for personal use only.

5.3 Orders placed online constitute an offer to purchase, which is subject to our acceptance.

5.4 A contract is formed only when we send a Shipping Confirmation (or, for pre-order Products, a dispatch confirmation).

5.5 Risk transfers:

  • In-store: when handed to you
  • Online: upon delivery

5.6 Pre-Orders / Reserved Products

Where you purchase a Product on a pre-order or “reserve” basis:

  • The Product is not available for immediate dispatch
  • A contract will be formed only when the Product is dispatched
  • Any delivery timelines stated elsewhere apply only after dispatch
  • Dispatch may be subject to manufacturing, quality control, or supply timelines
  • Any estimated release or dispatch dates are indicative only and not guaranteed

We reserve the right to delay, limit, or cancel pre-orders where necessary, including due to supply constraints or quality control requirements. In such cases, you will be offered a refund.

6. PRODUCT PRICES

6.1 Prices are displayed in EUR and include VAT (where applicable).

6.2 Delivery charges may apply.

6.3 In the event of pricing errors, we reserve the right to cancel or correct orders prior to dispatch.

7. PAYMENT METHODS

7.1 Payment methods are listed at checkout.

7.2 We may perform fraud prevention and verification checks.

7.3 Orders may be cancelled if payment fails or cannot be verified.

8. DELIVERY OF YOUR PURCHASE OR ORDER

8.1 Delivery Timeframes
Delivery times are estimates only and not guaranteed, and apply only once an order has been dispatched.

8.2 Delivery Method
Orders are shipped via DPD or an equivalent courier.

Delivery is complete when Products are delivered to the address provided.
Risk transfers at delivery.

8.3 Delivery Locations
We deliver to:

  • France
  • United Kingdom
  • Other locations may be offered at checkout

8.4 Shipping Costs

  • Free shipping to France and the United Kingdom
  • Other destinations calculated at checkout

8.5 Partial Deliveries
Orders may be shipped in multiple deliveries.

8.6 Failed Delivery
If delivery fails due to customer error:

  • Additional fees may apply
  • Costs may be deducted from refunds

8.7 Returned Shipments
If returned due to non-collection or refusal:

  • Shipping costs may be deducted
  • Re-shipping may require payment

8.8 Customs
Customers are responsible for customs compliance, duties, and charges.

8.9 Inspection
You must inspect Products upon delivery and report issues promptly.

9. RETURNS AND REFUNDS

9.1 General
You have the right to return Products within 14 days of delivery in accordance with applicable consumer law.
We may extend this to 30 days as a commercial policy.

9.2 Conditions
Products must:

  • Be unused
  • Be in original packaging
  • Include all documentation

9.3 Hygiene Rule
Due to hygiene and safety reasons:
Opened or unsealed Products cannot be returned unless faulty or damaged.

9.4 Refunds
Refunds include:

  • Product price
  • Delivery costs where legally required

Refunds are processed within 30 days of receiving returned goods.

9.5 Shipping Interaction

  • Return shipping is paid by the customer unless the Product is faulty
  • For free shipping orders, we may deduct the actual outbound shipping cost

9.6 Defective Products

9.7 Inspection Requirement
You must report defects:

  • Without undue delay for visible issues
  • Within a reasonable time for hidden defects

9.8 Remedies

10. SERVICES & GIFT CARDS

  • Any liability which cannot be excluded by law

Otherwise, we are not liable for:

  • Indirect or consequential losses
  • Business losses
  • Misuse of Products

Use of the Website is governed by our Website Terms of Use.

13. PERSONAL DATA

Personal data is handled in accordance with our Privacy Policy.

14. FORCE MAJEURE

We are not liable for delays or failure to perform obligations due to events beyond our reasonable control.

15. AMENDMENTS

We may update these Terms from time to time. The version in force at the time of your order will apply.

17. OTHER IMPORTANT INFORMATION

These Terms are governed by French law.
The courts of France shall have jurisdiction, subject to mandatory consumer protection rights in your country of residence.
